Tahawwur Hussain Rana To Be Extradited To India: Major Win In 26/11 Mumbai Terror Case
The recent decision clears the way for the transfer of Rana to India.
An American court has allowed the extradition of Tahawwur Hussain Rana, an accused in the 26/11 terror attack in Mumbai. It is a significant victory for India, as India had been waiting for long to have Rana extradited to this country to do justice in the case of the 2008 terror attack.
The U.S. Ninth Circuit Court of Appeals has recently affirmed an order from the lower court that dismissed Rana's habeas corpus petition to challenge the extradition certification made by the magistrate judge. Rana had been protesting his extradition under the extradition treaty between the United States and India. The recent decision clears the way for the transfer of Rana to India.
Rana was brought into the United States from India against his alleged involvement with Lashkar-e-Taiba terrorists who attacked 26/11. NIA has been investigating him on these attacks that claimed over 170 victims and destroyed part of the city of Mumbai. Indian authorities have coordinated efforts with the United States to bring Rana into India through diplomatic channels. As reported by NIA officials, all arrangements for extradition have already begun to be done.
An Economic Times report on 15th August 2024 mentioned that the District Court dismissed an appeal filed by Rana related to his order of extradition. Hence, all the orders through U.S. Court have sanctified the existing agreement of extradition between two nation India and U.S. The jurisprudence provided by dealing with the above matters is applicable and relevant enough to tackle situations of terror attack.
This move has put the Indian authorities at the hook of some final processes so that Rana is transferred to India for his trial for this alleged involvement in one of the worst terror attacks in the history of the country.
